The property shall not be used by more than the number\nof adults and children listed in your reservation.<\/p><p>\u00a0B. All guests shall abide by Vacasa\u2019s good neighbor policy\nand shall not engage in illegal activity. Quiet hours are from\n10 p.m. to 8 a.m.<\/p><p>C. No pets of any kind are allowed.<\/p><p>D. Renter must be at least 21 years of age (or the specified\nminimum age required to rent the property, if different).\nGuests under the minimum age must be accompanied by a\nparent or legal guardian.\u00a0<\/p><p>E. No smoking is permitted anywhere on the premises.\u00a0<\/p><p>F. No commercial photography or filming is permitted on the\nproperty. Tents or other structures may not be erected. Use\nof charcoal grills is not allowed.\u00a0<\/p><p>G. Renter is liable for any damage to the property and\nagrees to accept charges to the card on file should damage\noccur during occupancy.<\/p><p>H.\u00a0Cancellation Policy: If you cancel within 24 hours of\nbooking, you&#039;ll receive a full refund. After that, if you cancel\n30 or more days before the first night of your reservation,\nyou&#039;ll receive a refund of any rental payments you&#039;ve made,\nminus the booking fee.<\/p><p>I.\u00a0Travel Insurance: We recommend that you purchase\ntravel insurance to help protect against financial loss if you\nmust cancel your reservation for a covered reason.<\/p><p>J. Check-in time will be at 3:00 pm, and check-out time will be at 11:00 am.\u00a0<\/p><p><b>RENTAL POLICIES AND GENERAL TERMS<\/b><\/p><p>A.\u00a0Minimum Age.\u00a0 The Minimum Age is 21 years of age\nYou agree to provide us with proof of age upon request. A\nparent or legal guardian must accompany all guests who\nare under the Minimum Age for the entire duration of the\nrental.<\/p><p>B.\u00a0Responsible Renter.\u00a0As the Renter, you agree to be an\noccupant of the Property for the entire duration of the rental.\nAll other occupants will be family members, friends, other\nresponsible adults over the Minimum Age, or accompanied\nby a parent or legal guardian. You agree to be solely\nresponsible for your actions and the actions of all family members, guests, and invitees (collectively, \u201cOccupants\u201d)\npresent at the Property at any time during your stay, and to\nensure that all Occupants understand and comply with the\nTerms.<\/p><p>C.\u00a0Good Neighbor Policy.\u00a0Because the Property is a\nprivately owned home, all Occupants must comply with this\ngood neighbor policy. Please treat the Property with the\nsame care you would use with your own residence and\nleave it in the same condition it was in when you arrived. To\nprevent theft of or damage to furnishings or your personal\nproperty, you agree to close and lock doors and windows\nwhen you are not present at the Property and upon check-\nout. You and other Occupants agree to conduct yourselves\nthroughout your stay in a manner that is respectful of and\nnot disruptive to neighbors, traffic flow, or the community\nand that will not prompt complaints from police, neighbors,\nor neighborhood or homeowner associations. Noise audible\noutside the Property is prohibited between 10 p.m. and 8\na.m. You and other Occupants agree to abide by all\napplicable parking restrictions and limitations.<\/p><p>D. Maximum Occupancy.\u00a0The number of people present at\nthe Property may not exceed the maximum posted\noccupancy<\/p><p>E.\u00a0No Smoking.\u00a0No smoking is permitted at the Property\n(including porches, decks or outdoor areas) at any time.<\/p><p>F.\u00a0No Permanent Residence.\u00a0You agree that your use of\nthe Property is on a temporary and transient basis only; that\nyou may not use the Property as a permanent residence;\nand that your permanent residence is and will remain\nelsewhere than at the Property.<\/p><p>G.\u00a0Animals.\u00a0No animals or pets of any kind are permitted at\nthe Property. You agree that a prohibition on animals is not\na guarantee than an animal has not been inside the\nProperty or that the Property is free of animal or pet\nallergens.<\/p><p>H. Events and Commercial Photography; Structures;\nCharcoal Grills.\u00a0Events and commercial photography or\nfilming are prohibited at the Property without our express\nwritten permission. (If approved, additional conditions and\nfees may apply.) No tents or other structures may be\nerected on the property without our express written\npermission. The use of charcoal grills is not permitted.<\/p><p>I. Criminal Activity Prohibited.\u00a0Use of the Property for any\ncriminal activity is prohibited and may result in fines,\nprosecution, and\/or your immediate removal from the\nProperty. This prohibition extends to use of the Property\u2019s\ninternet service, if any, for criminal activity, including but not\nlimited to unlawful downloads of copyrighted material,\nincluding movies, music, software, or other material. We\nmay cooperate with any investigation of alleged criminal\nactivity that occurred at the Property during your stay.<\/p><p>J. Payment Terms; Fraud.\u00a0If you are paying by credit card\nyou represent that you are the account holder or an\nauthorized user of the account. We will to ask you send the\nproof that you are the account holder or an authorized user\nof the account used for payment (such as a scan or copy of\ngovernment-issued ID that matches the name on the\naccount). We may cancel your reservation or remove you\nand all Occupants from the Property immediately if you fail\nto provide a form of payment that can be validated by us.\nWe may share your credit card information and other\ninformation about you with law enforcement if we suspect\nfraud.<\/p><p>K. Consequences of Breach; Charges for Damage.\u00a0Any\nfailure by you or any other Occupants to comply with any of\nthe terms, conditions, or policies above is a breach of this\nAgreement and may result in a forfeiture of your rights to\nrent the Property, up to and including immediate removal\nfrom the Property without refund and with or without the\nassistance of law enforcement. We may terminate this\nAgreement for breach, and if you are notified of such\ntermination you agree to leave the Property immediately. In\naddition, you are responsible for, and you authorize us to\nbill your credit card on file for the full amount of: (1) any\ndamage or loss that occurs at the Property during your stay;\n(2) a charge of up to $1,000 for violations of the pet policy,\nincluding for bringing more pets or different types of pets\nthan specifically authorized; (3) an additional cleaning fee of\nup to $500 (or the actual cost of cleaning services, if\n\ngreater) for violations of any of the guest policies above\n(other than the pet policy) or for excessive cleaning required\nby the acts or omissions of any Occupant during your stay;\nand (4) any fines issued by police, other government\nofficials or agencies, utility providers, and\/or homeowner\nassociations for violation of any law, ordinance, or rule\nduring your stay, and any damages (which may exceed the\namount of fines) that result from the violation. If any\nunauthorized download of copyrighted material via the\nProperty\u2019s Internet service occurs during the period of your\nstay, you agree that we may share your contact information\nwith the internet service provider or any other party we\nbelieve, for any reason, has enforcement rights.<\/p><p>ADDITIONAL TERMS AND CONDITIONS<\/p><p>L. Cancellation Policy; No presentation. Rental payments are fully refundable (less the booking fee amount, which is earned upon receipt and is non-refundable 24 hours after booking) for cancellations received 30 or more days prior to the first night of your reservation. We recommend guests obtain adequate and comprehensive travel insurance that covers the tenant and all Occupants, and includes coverage for personal injury, illness or disease, and property damage or loss.<\/p><p>M. Travel Insurance.\u00a0We advise guests to obtain\nappropriate and comprehensive travel insurance that covers\nRenter and all Occupants and that includes coverage for\npersonal injury, illness or disease, and property damage or\nloss, and to help protect against financial loss if you must\ncancel your reservation for a covered reason.<\/p><p>N. Early Check-In\/Late Check-Out.\u00a0Early check-in or late\ncheck-out may be available; additional charges may apply.\nIf you do not vacate by check-out time, you authorize us to\nbill your credit card on file for a late departure fee of up to\none night\u2019s rental and we may remove all Occupants and\ntheir personal property from the Property if they stay in\nproperty after agreed time.<\/p><p>O. Maintenance or Cleaning Issues; Property Conditions. The property is provided as is, and we are not responsible for the inoperability or unavailability of any amenity. You agree to contact us, using the contact information provided in your confirmation email, as soon as you notice any maintenance or cleaning issue or any potentially hazardous condition on the property, or if any incident related to such a problem or condition occurs on the property. Additionally, you agree to give us a reasonable amount of time to respond to your report and cooperate with our efforts to address the concern or provide a remedy. We will take reasonable and appropriate steps to remedy any reported problem as soon as possible. We may enter the property upon your invitation to remedy any reported problem, at reasonable times and with reasonable notice, to inspect, maintain, or repair the property, and to address any situation that we reasonably consider an emergency threatening persons or property.<\/p><p>P. Waiver of Class Action and Jury Trial. The parties agree that any dispute resolution proceedings shall be conducted solely on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, the parties waive any right to a trial by jury.<\/p><p>Q. Acknowledgment &amp; Disclaimer; Limitation of\nLiability.\nQ.1. Acknowledgment &amp; Disclaimer.\u00a0You acknowledge\nthe Property may have features, amenities, and\nconditions that are unfamiliar to you and other\nOccupants you invite to the Property. You further\nacknowledge that your use of the Property and its\namenities may carry inherent risk, including risk of\nbodily injury, illness or disease, disability, or death. For\nexample, some Properties include natural habitats for\nwildlife, insects, and pests that may expose you to\ninjury or disease; or docks, stairways, porches, ledges,\ncliffs, hot tubs, and other unmarked natural or\nmanmade features, amenities, and conditions that carry\ninherent risk. You agree that, by using the Property or\nits amenities, you voluntarily and willfully assume\n\nthose risks and assume full responsibility for the\nchoices you make before, during and after your use of\nthe Property and its amenities. You also acknowledge\nand agree that you and any other adult Occupants are\nsolely responsible for closely supervising and\nprotecting the health and safety of any and all\nOccupants that are minors, throughout the duration of\nyour stay.<\/p><p>Q.2. Disclaimer of Warranties. TO THE MAXIMUM\nEXTENT PERMITTED BY LAW, VACASA AND OWNER\nEACH EXPRESSLY DISCLAIM ANY WARRANTIES OF\nSAFETY, FITNESS FOR A PARTICULAR PURPOSE,\nQUIET ENJOYMENT, AND AS TO THE ADEQUACY OF\nTHE DIRECTIONS AND WARNINGS PROVIDED TO YOU.<\/p><p>Q.3. Limitation of Liability.\u00a0TO THE MAXIMUM EXTENT\nPERMITTED BY LAW, IN NO CASE SHALL THE OWNER\nOF THE PROPERTY OR VACASA, NOR THEIR\nAFFILIATES, NOR THEIR RESPECTIVE OFFICERS,\nDIRECTORS, EMPLOYEES, AGENTS, OR OWNERS, BE\nLIABLE FOR ANY INDIRECT, INCIDENTAL,\nCONSEQUENTIAL, SPECIAL, OR EXEMPLARY\nDAMAGES, OR FOR ANY DAMAGES FOR PERSONAL\nOR BODILY INJURY, ILLNESS OR DISEASE,\nEMOTIONAL DISTRESS, OR DAMAGE TO PROPERTY,\nARISING OUT OF OR IN CONNECTION WITH YOUR\nSTAY AT THE PROPERTY. THIS LIMITATION APPLIES\nTO ALL CLAIMS FOR DAMAGES WHETHER BASED ON\nA THEORY OF WARRANTY, CONTRACT, TORT\n\n(INCLUDING ORDINARY NEGLIGENCE), STRICT\nLIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN\nADVISED OF THE POSSIBILITY OF SUCH DAMAGE\nAND EVEN IF THE LIMITED REMEDY SET FORTH\nHEREIN IS FOUND TO HAVE FAILED OF ITS\nESSENTIAL PURPOSE.<\/p><p>R. Indemnity.\u00a0You agree to hold harmless and indemnify\nOwner, and their respective affiliates, for and from all claims\nfor property damage, personal injury, illness or disease, or\nmonetary loss resulting from your actions or omissions, and\nthe actions or omissions of other Occupants, during or\nrelating to your stay.<\/p><p>S. Substitution of Property.\u00a0On rare occasions, due to\nextensive repairs or maintenance, the Property may not be\navailable for rental on the dates of your reservation. In this\nunlikely event, we reserve the right to substitute a\ncomparable property. If comparable accommodations are\nnot available, you will have the option of (1) selecting from\nother available properties (in which case you are\nresponsible for, or will receive the benefit of, any difference\nin cost) or (2) receiving a complete refund of your\nreservation payment. In the event of a substitution of rental\nproperties, all Terms in this Agreement, plus any Unit-\nSpecific Terms specific to the substituted property, shall\napply to your stay in the substituted property.<\/p><p>T.
